This complaint is in regards to my loan with LP Finance Group, LLC for the purchase of a spa in XX/XX/year>. I am writing to express my concern regarding the lack of transparency and accessibility for my loan account. As there is currently no online portal or regular quarterly statement provided, I do not have clear visibility into my account status. The original purchase price was {$8500.00}. After a down payment of {$2400.00}, the remaining principal was {$6100.00}. I have been making monthly installments of {$170.00} and have paid a total of {$4400.00} to date. However, I recently received a payoff quote of {$4400.00}, which raises concerns about how my payments are being allocated between principal and interest. Despite previous requests, I have not been provided with a detailed statement, or any information regarding my interest rate, as me nations there is no access to an online portal. I receive a generic email monthly with my payment amount and the date itll be withdrawn from my account. However I need and want an itemized statement of my account that clearly shows the application of all payments made to date, the pay-off amount and if there is an early pay off amount. I would also like to know the interest rate I am being charged as that is not disclosed either.

I financed a XXXX XXXX XXXXXXXX tanning bed through XXXX XXXX XXXX. The merchandise delivered by the seller ( XXXX ) was defective and unusable from the moment it arrived. Immediately after delivery, I contacted the seller and manufacturer multiple times by email and phone. I received no response and no effort to repair, replace, or resolve the defective merchandise. Because the seller refused to respond, I submitted a written dispute to XXXX XXXX under the FTC XXXX XXXX, which is printed directly in my signed Retail Installment Contract. The contract states that ANY HOLDER of the consumer credit contract is subject to all claims and defenses that the debtor could assert against the seller. Despite this, XXXX XXXX responded in writing stating that the FTC XXXX XXXX does not permit a consumer to assert claims or defenses directly against the finance company or withhold payment. This statement is false, misleading, and contradictory to the mandatory language included in the contract and required under federal law. XXXX XXXX is misrepresenting my rights under the FTC XXXX XXXX and is refusing to acknowledge that the account is subject to a legitimate dispute regarding defective merchandise. They also stated they will continue reporting the account without reflecting the dispute, which would be inaccurate. I am currently making payments on a product that arrived defective, can not be used, and has not been supported by the seller or manufacturer. XXXX XXXX continues to insist I must pay in full regardless of the unresolved dispute and in contradiction to the XXXX XXXX. This appears to be : A misrepresentation of federal consumer protection law A refusal to properly acknowledge and document my dispute A violation of the Holder Rule A potential violation of the Fair Credit Reporting Act if the dispute is not noted Unfair and deceptive conduct by a finance company I am requesting CFPB assistance due to the finance companys failure to follow federal law and properly handle a dispute involving defective merchandise financed through them.

LP Financial INC XXXX XXXX XXXX XXXX Issue : False credit reporting of non-existent secured loan ; threats and refusal to resolve product dispute. Summary : In XX/XX/XXXX, I purchased a hot tub from XXXX XXXX XXXX XXXX and paid in full with a credit card. The product was delivered damaged, which was documented at delivery and reported to the company. After repeated failed attempts to resolve the issue, I filed a dispute with XXXX XXXX, which ruled in my favor and issued a full chargeback in XX/XX/XXXX. In XX/XX/XXXX, LP Finance, also known as XXXX XXXX XXXX, contacted me demanding repayment or product recovery. I agreed to return the unit but requested a release of liability, which they refused. Since then, I have been subjected to aggressive and repeated threats, including calls stating that LP Finance would pursue legal action. No legal action was taken only continued harassment. More concerning, LP Finance reported a false tradeline to XXXX, describing the transaction as a 66-month secured loan, despite the fact that this was a credit card transaction with no financing agreement. After I disputed the entry with XXXX, LP Finance verified the false information. Their actions constitute willful false credit reporting. Pattern of Misconduct : LP FinanceXXXX XXXX XXXX has a documented history of misconduct. They have : Over XXXX XXXX complaints in the past three years, Been placed on a consumer protection watch list by the Arizona Attorney General following complaints of misrepresentation, Previously entered into a settlement agreement with the XXXX XXXX XXXX over regulatory issues. This is not an isolated incident. Their actions are part of a systemic pattern of abusive consumer practices, and their refusal to correct a clearly false credit report entry demonstrates intentional harm. Requested Resolution : Immediate removal of the false tradeline from all credit bureaus. Written confirmation that the matter is resolved in full. Cease all further collection attempts and harassment. I have included the demand letter I sent certified to XXXX XXXX XXXX XXXX Within the demand letter each exhibit shows Exhibit A - This was not a secured loan, rather a retail transaction paid in full by credit card. Exhibit B - Delivery document ( XXXX ) showing damage to the product upon arrival. Exhibit C - Falsified XXXX trade account showing a secured loan with a term of 66 months. Exhibit D - XXXX XXXX dispute resolution in our favor. Exhibit E - Written communication from XXXX, XXXX to receive product even if damaged. Exhibit F - Original XXXX XXXX XXXX showing proof of purchase. ( Retail transaction )

Company response: Closed with explanation
This complaint is in regard to an unauthorized charge made to my debit card ending in XXXX on XX/XX/year>, in the amount of {$360.00}. Let me be absolutely clear : I did not authorize this payment. I did not give permission for my debit or credit card to be stored, nor did I agree to any automatic charges to my checking account or any linked payment method. You had no right to access or charge my account. This behavior is presumptuous, invasive, and completely unacceptable. I am demanding immediate written confirmation that : 1. All of my financial information has been permanently removed from your system. 2. No further automatic payments will be processed, now or ever, without my explicit, written authorization via email. This is not a request. This is a formal boundary. Any further unauthorized charges will be treated as fraudulent and escalated accordingly including disputes through my financial institution and complaints filed with the appropriate regulatory agencies. You do not have permission to charge me again. Make sure every department involved understands that clearly.
