Date : XX/XX/XXXX To : XXXX County Habitat for Humanity XXXX XXXX XXXX XXXX, AL XXXX From : XXXX XXXX XXXX XXXX XXXX XXXX, AL XXXX RE : Information Request Mortgage loan number : XXXX XXXX I am writing to request the information described below regarding the mortgage on my property at XXXX XXXX. Specifically, Im requesting the following information : Assumption of the mortgage I would like to know the steps I need to take in order put my name on mortgage. This matter is being handled by my lawyer. Mortgage and Loan Analysis of account. This statement would include all deposits, credits, debts, and fees assessed to my account. This statement would include all payments ( payment history ) made from XXXX to current date, in Chronological order. This statement would have the current Principal balance of the account as is to date. This statement would include all payments made from my escrow account disbursement. Provide me with a copy of all papers related to XXXX XXXX Alabama Include an explanation as to why the {$30000.00} from XXXX XXXX failed to pay off my mom s mortgage if she only owed you {$15000.00} at the time ( this is what Habitat told my mom ). Around XXXX my mom began struggle to make ends meet and to pay her mortgage payments, which resulted in her applying for mortgage assistance with XXXX XXXX Alabama. To my understanding this would help XXXX get caught up on her mortgage and pay her mortgage in full ; at least that was what XXXX told XXXX would happen. During this time ( XXXX ) she continued to receive letters in the mail about late payments and possible foreclosure, while during this time XXXX was sending her monthly statements from XXXX XXXX Alabama to cover her for the month. I need Clarification on how the XXXX XXXX Alabama funds was applied to the mortgage since it did not result in XXXX home being paid in full. Between XXXX my mom did not receive any mortgage statements on her account and was unable to verify how her mortgage payments and account was being handled. In XXXX a Mortgage Cancellation and Release was filled with the state of Alabama. It stated that XXXX mortgage was paid in full and fully released, satisfied, discharged, and cancelled. Please explain!!! I spoke with XXXX XXXX ( executive Director ) on multi occasions about this matter and each time she refused to discuss the issues with me. She said that her lawyer advised her not to discuss anything with me about the mortgage. Since the mortgage is still in my mom, XXXX XXXX name. XXXX XXXX just ask for a copy of my Quit Claim Deed. I gave her a copy of the quit claim deed and yet she still did not give me any information about what I need to do or anything about the mortgage. On XX/XX/XXXX, I called Habitat for Humanity International at XXXX complaint line and spoke with someone about my issue. The representative just said that she documented my complaint and would get it to the right person. Well, she just called XXXX XXXX about the issue and had her to give me a call. On XX/XX/XXXX, XXXX XXXX called me because Habitat for Humanity International asked her to speak with me about my issue ( why didnt Habitat International investigate my complaint further ). XXXX XXXX just stated that whenever I have any questions about my mortgage to call her because the Habitat office in XXXX, AL is just an affiliate of Habitat for Humanity International and does not know about my situation. XXXX XXXX also stated that she had finally talked to her lawyer about assuming the mortgage into my name. She stated that the lawyer was looking into what to do about the assumption of mortgage. XXXX XXXX also stated that the lawyer had been busy, and she would contact me as soon as the lawyer contacted her and that I should continue to make my monthly mortgage payments. I have been waiting for over 4 months for some answers. It has been over 4months since my mom passed and I have been given the run around. I just want to be respected as a person and acknowledged as a homeowner and for Habitat to provide me with information that I lawfully have a right too. Thank you for taking the time to acknowledge and answer this request. If you need to contact me, I can be reached at the above address or XXXX and XXXX. Supporting documents is attached. Sincerely, XXXX XXXX XXXX : XX/XX/XXXX To : XXXX County Habitat for Humanity XXXX XXXX XXXX XXXX, AL XXXX From : XXXX XXXX XXXX XXXX XXXX XXXX, AL XXXX RE : Notice of Error Mortgage Loan Number : XXXX XXXX I am writing to request correction of the errors described below regarding the mortgage on my property at XXXX XXXX XXXX. Specifically, Im requesting correction to the following errors : Your company failed to provide an accurate principal balance on XX/XX/XXXX, Mortgage statement ( Amount much higher than expected ) I was looking over my moms mortgage paperwork in XXXX of XXXX ; when I noticed two errors on one of her mortgage statements ( XX/XX/XXXX, statement ). The first error I noticed was the total principal balance amount was {$32000.00}. I immediately looked at XXXX next to the last mortgage statement that she received in XXXX, which had a principal balance of {$11000.00} ( my moms home should be paid in full by now ). What is really going on here! Since my mom never received most of her monthly statements from habitat, she was unable to keep track and verify how her mortgage payments and principal balance, was being handled. And the last two years of her life she was too sick to handle her business. The {$32000.00} balance need to be corrected to show the actual amount owed ( Which should say paid in full ). The second error will be discussed below. Yor company failed to provide an accurate Silent 2nd Mortgage amount owed ( Silent 2nd mortgage should be paid in full after 20 years ) On the XX/XX/XXXX, mortgage statement ( last statement XXXX received ) I noticed that there was a 2nd mortgage balance of {$9500.00}. To my knowledge the Silent 2nd mortgage is to keep homeowners from selling their homes quickly for a profit. The Silent 2nd mortgage is supposed to decrease every year by a certain percentage ; so that in 20 years it has been paid off. My mom has been in her home since XXXX ; this is over 20 years ago! Her Silent 2nd mortgage should be paid in full. Why is there still a balance? Provide me with all documentation showing how the Silent 2nd mortgage was decreased each year. Since I lost my mom in XX/XX/XXXX, I have contacted XXXX XXXX many times trying to find out what I needed to do to assume the mortgage in my name and get answers to the other issues I have noticed since I looked over my moms paperwork. XXXX XXXX has been giving me the run around by refusing to tell me anything about the mortgage and keep stating that she must talk to her lawyer. If you need to contact me, I can be reached at the above address or XXXX or XXXX. Supporting documents is attached. Sincerely, XXXX XXXX XXXX XXXX ReStore XXXX XXXX XXXX ( 5 hours ago ) to XXXX XXXX me XXXX XXXX XXXX I sent an email to your attorney advising him that my office will be sending him correspondence in reference to the certified letter that we received. Please be aware that XXXX XXXX XXXX did not have a free and clear mortgage and therefore we are the lienholder of the said property. You were not listed on the mortgage. I will send your attorney information regarding payoff so that you can try and obtain financing of said property. Thanks XXXX XXXX Executive Director XXXX County Habitat for Humanity -- XXXX County Habitat for Humanity ReStore XXXX XXXX XXXX. XXXX, AL XXXX XXXX XXXX XXXX
